Terms of Service

By accessing and using the services provided by Gravity Host, you agree to be bound by these Terms of Service.
1. Provider Identification

2. Acceptance of Terms
By accessing and using the services provided by Gravity Host, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use the Service.
3. Services Provided
Gravity Host provides high-performance cloud hosting, game server hosting, VPS hosting, and related infrastructure services. Services are available in our EU region (Brussels, Belgium) and our NA region (New York, United States); the region is selected by you at the point of order. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any feature, database, or content.
4. Account Responsibilities
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
5. Payments, Billing & Refunds
All services are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Gravity Host cancels it. A valid payment method is required to process the payment for your Subscription. GOODWILL REFUND POLICY: We offer a 3-day money-back guarantee for new server purchases. After 3 days from the initial purchase date, no goodwill refunds will be issued. Goodwill refunds do not apply to account credits or renewals. This goodwill policy is offered in addition to, and does not limit, your statutory rights as a consumer described in Section 6.
6. Consumer Right of Withdrawal
If you are a consumer resident in the European Union, you have a statutory right to withdraw from a distance contract within 14 days without giving reasons. Because our services are provisioned immediately, you will be asked to expressly request that we begin performance before the withdrawal period has expired and to acknowledge that you thereby lose your right of withdrawal once the service has been fully performed. Where you withdraw after performance has begun but before it is complete, you owe a proportionate amount for the service already provided. To exercise the right of withdrawal you must inform us by a clear statement sent to legal@gravityhost.org. This section applies only to consumers. It does not apply to business customers.
7. Your Content and Your Responsibilities
You retain all rights in the data, files, databases, websites and other content you or your users upload to, store on, or transmit through our infrastructure ("Customer Content"). You are solely responsible for Customer Content, including its lawfulness and for having a valid legal basis for any personal data it contains. You are responsible for maintaining your own backups. Backups we provide are a convenience and not a substitute for your own. We do not access Customer Content except where necessary to operate, secure or repair the Service, to respond to a support request you have raised, or where we are legally required to do so.
8. Data Protection and Data Processing Agreement
Where we process personal data relating to your own end users that is contained in Customer Content, we act as a processor and you act as the controller within the meaning of Art. 4 GDPR. That processing is governed by a Data Processing Agreement under Art. 28 GDPR. A Data Processing Agreement is available on request from privacy@gravityhost.org and forms part of these Terms once concluded. If you host personal data of third parties on our infrastructure, you should conclude one before doing so. Our own processing of your account and billing data, where we act as controller, is described in our Privacy Policy.
9. Prohibited Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service: - In any way that violates any applicable national or international law or regulation. - To transmit, or procure the sending of, any advertising or promotional material, including "junk mail", "spam", or any other similar solicitation. - To impersonate or attempt to impersonate Gravity Host, a Gravity Host employee, another user, or any other person or entity. - To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service. - To operate any service or infrastructure not covered by your plan, including running your own control panel or daemon on our nodes without written permission. - For any crypto-mining activities unless explicitly permitted by your specific plan.
10. Suspensions and Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. Following termination, Customer Content on the affected service is retained for 14 days so that you can request an export, and is then deleted from active systems. Residual copies in backups are removed in the normal backup rotation described in our Privacy Policy.
11. Uptime and Service Disclaimer
While we strive for 99.9% uptime, your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including statutory warranty rights of consumers.
12. Limitation of Liability
In no event shall Gravity Host, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. We remain liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under mandatory statutory provisions including product liability law.
13. Governing Law and Dispute Resolution
These Terms are governed by the law of Germany, excluding its conflict of law rules. Where you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
